1. Introduction
These terms and conditions govern the sale of products through our website www.dearmaryjewellery.co.uk ("the Website"). By placing an order on the Website, you agree to be bound by these terms and conditions.

2. Definitions
"Seller", "we", "us", or "our" refers to Dear Mary Ltd.
"Buyer", "you", or "your" refers to the person or entity purchasing products from the Website.
"Products" refers to vintage, antique, and second-hand jewellery items available for purchase on the Website.
"Order" refers to a purchase made by the Buyer on the Website.

3. Ordering
3.1 By placing an Order on the Website, you warrant that you are legally capable of entering into a binding contract and that you are at least 18 years old.
3.2 All Orders are subject to availability and acceptance by us. We reserve the right to refuse or cancel any Order for any reason at our sole discretion.
3.3 If an item is claimed from the Dear Mary Crew page, the Buyer has 30 minutes to complete their Order before we move on to the next customer.

4. Prices and Payment
4.1 All prices listed on the Website are in GBP (British Pounds) and inclusive of VAT (where applicable), but exclusive of delivery charges.
4.2 Payment for Orders must be made in full at the time of placing the Order. We accept payment by credit/debit card and PayPal.

5. Condition of Goods (Sold as Seen)
5.1 All items listed on the Website are pre-owned, vintage, or antique and are sold in their current condition.
5.2 We take care to provide accurate descriptions and images; however, all items will show signs of age and wear consistent with their history.
5.3 The Seller makes no warranties or representations, express or implied, regarding condition, quality, or fitness for a particular purpose beyond those required by law.
5.4 Purchasers accept all items in their current condition, including any faults, wear, or imperfections as described or visible.

6. UK Delivery
6.1 We will make every effort to deliver Products within the estimated timescales; however, delays may occur due to circumstances beyond our control.
6.2 UK delivery is free of charge via Royal Mail Special Delivery.
6.3 Orders are typically packaged and dispatched within 1–2 working days unless alterations are required.
6.4 Once shipped, UK deliveries are usually expected within 1–2 working days.
6.5 If resizing or alteration is requested, please allow an additional 14 working days.

7. International Shipping
EU and Northern Ireland customers: At present, we are only able to ship fully hallmarked antique items to your region.

7.1 International orders may be subject to country-specific customs duties and/or taxes payable on delivery.
7.2 The Buyer is responsible for any customs duties, taxes, or import fees that may apply.
7.3 For legal and insurance purposes, we will declare the full purchase value on all customs documentation.
7.4 If duties or taxes are refused and the item is not safely returned, no refund will be issued. If returned, any fees incurred will be deducted from the refund.
7.5 A flat charge of £35 applies for international shipping via DHL Express.
7.6 Orders are typically dispatched within 1–2 working days unless alterations are required.
7.7 International deliveries are usually expected within 5–7 working days.
7.8 If resizing or alteration is requested, please allow an additional 14 working days.

8. Returns and Refunds
8.1 If you are not satisfied with your purchase, you may return it within 14 days of delivery for a full refund, excluding return postage costs.
8.2 The Buyer is responsible for return shipping and must ensure the item is returned safely via a fully insured and trackable service. We recommend Royal Mail Special Delivery for UK returns.
8.3 International returns must be clearly marked as “UK RETURNED GOODS” and sent via DHL Express, fully insured. Any costs incurred due to incorrect labelling will be deducted from the refund.
8.4 Returned items must be in their original condition and packaging.
8.5 Items that have been altered, resized, or customised cannot be returned. It is the Buyer’s responsibility to confirm correct sizing prior to purchase.
8.6 Any damage in transit must be reported within 24 hours of delivery with photographic evidence.

9. Sale Items and Condition Disclosure
9.1 Items purchased at a discounted price (including clearance or promotional offers) are non-returnable unless materially faulty or not as described.
9.2 Buyers acknowledge they have reviewed all descriptions and images prior to purchase. This does not affect statutory rights.

10. Fit for Purpose and Gemstone Information

10.1 Fit for Purpose
10.1.1 We take care to describe each piece accurately; however, we do not guarantee suitability for any specific purpose, including daily wear, unless explicitly stated.
10.1.2 Antique, vintage, and second-hand jewellery may have inherent characteristics, wear, or structural nuances due to age.

10.2 Professional Advice
10.2.1 Buyers are encouraged to contact us or consult a professional jeweller if they have any concerns regarding wearability or suitability.

10.3 Gemstone Identification and Authenticity
10.3.1 We do not operate a gemmological laboratory and, unless explicitly stated, gemstones have not been laboratory tested.
10.3.2 All gemstone identifications, descriptions, and attributions are based on our professional opinion and experience.
10.3.3 We make no express guarantees or warranties as to whether any gemstone is natural, synthetic, treated, or a simulant unless explicitly stated.
10.3.4 Buyers acknowledge that gemstone origin, treatment, and formation cannot always be definitively determined without advanced laboratory testing.
10.3.5 Synthetic gemstones have been in existence for over a century, and the antique or vintage nature of a piece does not preclude the presence of synthetic stones.

10.4 Stone Weights and Measurements
10.4.1 Where gemstone or diamond weights are provided, these are estimated as approximately unless otherwise stated.
10.4.2 In most cases, stones are measured while set, and exact weights cannot be determined without removal.
10.4.3 We do not use the term “assessed weight” and instead provide estimated weights based on standard industry practices.
10.4.4 Buyers acknowledge that stated weights are approximate and may vary from actual weights if stones are removed.

11. Intellectual Property
11.1 All intellectual property rights in the Website and its content are owned by us or our licensors.
11.2 You may not reproduce or distribute any content without prior written consent.

12. Limitation of Liability
12.1 To the fullest extent permitted by law, we shall not be liable for any indirect or consequential losses arising from use of the Website or Products.
